This website is operated by Scout Peak. Throughout the site the terms "we", "us" and "our" refer to Scout Peak. We offer this website, including all information, tools and services available from it, to you on the condition that you accept the terms, conditions, policies and notices set out here.

By visiting our site or buying from us you engage in our Service and agree to be bound by these Terms, including any additional terms and policies referenced within them or reachable by hyperlink. These Terms apply to everyone who uses the site, browsers and customers alike. If you do not agree with them, please do not use the site.

We reserve the right to refuse service to anyone, for any reason, at any time. Your content, excluding payment card data, may be transferred unencrypted across networks. Card information is always encrypted in transit.

We are not responsible if information on this site is inaccurate, incomplete or out of date. The material here is for general information and should not be your only basis for a decision.

Prices are subject to change without notice. We may modify or discontinue the Service, or any part of it, at any time without notice.

Certain products are available exclusively online and may be limited in quantity. They are subject to return or exchange strictly in line with our Refund & Return Policy. We try to display colours and dimensions as accurately as possible, but screens vary and we cannot guarantee an exact match.

We reserve the right to refuse or cancel any order, including where we suspect fraud or resale. You agree to provide accurate and current purchase and account information for every transaction.

7. Optional Tools

Occasionally information here contains typographical errors or inaccuracies relating to product descriptions, pricing, promotions or availability. We reserve the right to correct these and to cancel orders placed on incorrect information, even after the order is confirmed. Where we cancel for this reason, you are refunded in full.

13. Disclaimer of Warranties; Limitation of Liability

To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free service. Scout Peak and its owners, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim will not exceed what you paid for the product it relates to. Some states do not permit certain exclusions, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Scout Peak and its affiliates from any claim, demand, loss or expense, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the site.

15. Severability

If any provision of these Terms is found unlawful or unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.

16. Termination

These Terms remain in effect unless terminated by either party. We may terminate your access immediately if you breach them.

17. Entire Agreement

These Terms, together with our Shipping Policy, Refund & Return Policy, Privacy Policy and Payment Policy, constitute the entire agreement between you and Scout Peak.

18. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules.

19. Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

Any dispute arising out of or relating to these Terms, the site, or any product bought from us will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration takes place in Hudson County, New Jersey, or by telephone or video if you prefer, and judgment on the award may be entered in any court with jurisdiction.

Class action waiver. You and Scout Peak agree that claims may only be brought individually, not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this waiver is found unenforceable, the entire arbitration section is void.

Small claims exception. Either party may bring an individual claim in small claims court where it qualifies.

Opting out. Email info@scoutpeak.com with the subject line "Arbitration Opt Out" within 30 days of your first purchase, stating your name and order number. Opting out affects nothing else in these Terms.

20. Changes to Terms of Service

You can review the current version of these Terms on this page at any time. We may update them by posting a revised version here, and the updated Terms apply to orders placed after posting.
